{"id":13646,"date":"2026-07-27T15:43:07","date_gmt":"2026-07-27T13:43:07","guid":{"rendered":"https:\/\/orsingher.com\/?p=13646"},"modified":"2026-07-27T15:43:07","modified_gmt":"2026-07-27T13:43:07","slug":"industries-media-agcom-adopts-first-decision-on-equitable-remuneration-for-performers-under-the-italian-copyright-law","status":"publish","type":"post","link":"https:\/\/orsingher.com\/it\/industries-media-agcom-adopts-first-decision-on-equitable-remuneration-for-performers-under-the-italian-copyright-law\/","title":{"rendered":"INDUSTRIES, MEDIA | AGCOM adopts first decision on equitable remuneration for performers under the Italian Copyright Law"},"content":{"rendered":"<p>On 5 June 2026, AGCOM published\u00a0<a href=\"https:\/\/www.agcom.it\/provvedimenti\/delibera-90-26-cons\" target=\"_blank\" rel=\"noopener\">Resolution No. 90\/26\/CONS<\/a>\u00a0(the\u00a0<strong><em>RASI Resolution<\/em><\/strong>), determining the\u00a0equitable\u00a0remuneration due to audiovisual artists\u00a0and performers\u00a0under\u00a0<a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:1941-04-22;633\" target=\"_blank\" rel=\"noopener\">Article 84 of the Italian Copyright Law<\/a>\u00a0(<em>ICL<\/em>).\u00a0The RASI Resolution\u00a0represents AGCOM&#8217;s first application of the procedure\u00a0set out\u00a0in Articles 17 to 21 of\u00a0<a href=\"https:\/\/www.agcom.it\/provvedimenti\/delibera-95-24-cons\" target=\"_blank\" rel=\"noopener\">Resolution No. 95\/24\/CONS<\/a>.<\/p>\n<p>The\u00a0proceedings\u00a0were\u00a0initiated\u00a0by\u00a0RASI Rete Artisti Spettacolo per l&#8217;Innovazione Soc.\u00a0Coop. (<em>RASI<\/em>),\u00a0which asked\u00a0AGCOM to determine the remuneration due\u00a0by\u00a0Sky Italia\u00a0S.r.l. (<em>SKY<\/em>)\u00a0for the use of\u00a0cinematographic and assimilated audiovisual works included in RASI&#8217;s repertoire\u00a0over\u00a0the period 2015-2022.\u00a0In response,\u00a0SKY\u00a0maintained\u00a0that AGCOM\u2019s powers under\u00a0Article 84 ICL could only be exercised following the\u00a0entry into force of\u00a0<a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legislativo:2021-11-08;177\" target=\"_blank\" rel=\"noopener\">Legislative Decree No. 177 of 8 November 2021<\/a>\u00a0implementing\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/dir\/2019\/790\/oj\/eng\" target=\"_blank\" rel=\"noopener\">Directive (EU) 2019\/790<\/a>\u00a0on copyright in the Digital Single Market (the\u00a0Copyright Directive),\u00a0meaning that\u00a0any remuneration could only be\u00a0determined in respect of exploitations occurring\u00a0from 12 December 2021.<\/p>\n<p>Beyond the specific dispute, the\u00a0RASI\u00a0Resolution\u00a0represents\u00a0AGCOM\u2019s first\u00a0interpretation of the principles governing the determination of equitable remunerations\u00a0where\u00a0negotiations between collective management organisations and users\u00a0do not result in an agreement.<\/p>\n<p>In particular, AGCOM\u00a0clarified\u00a0that remuneration agreed under\u00a0lump-sum\u00a0or blanket licensing arrangements cannot automatically be relied upon in regulatory proceedings. While such agreements remain commercially legitimate, the Authority considered that any determination under Article 84 ICL must be based on objective, transparent and verifiable criteria capable of reflecting the actual economic value of the exploitation.<\/p>\n<p>The\u00a0Resolution\u00a0further\u00a0confirmed\u00a0that\u00a0the regime introduced by Legislative Decree No. 177\/2021 has no retroactive effect. As a result,\u00a0AGCOM\u00a0confined its assessment to exploitations taking place from\u00a012 December 2021 onwards, excluding the earlier period covered by RASI&#8217;s application.<\/p>\n<p>Finally,\u00a0AGCOM clarified the scope of Article 84 ICL with respect to foreign performers, considering that a substantial number of performers represented by RASI are foreign (mainly US performers).\u00a0According to\u00a0the Authority,\u00a0the remuneration right extends to performers involved in works produced or co-produced by Italian producers, works originating in EU Member States or works qualifying for protection under the reciprocity rules set out in Articles 185-189 ICL. Since no reciprocal audiovisual remuneration regime currently exists between Italy and the United States, AGCOM concluded that U.S. performers are not entitled to remuneration under Article 84 ICL.
