{"id":13638,"date":"2026-07-27T15:39:36","date_gmt":"2026-07-27T13:39:36","guid":{"rendered":"https:\/\/orsingher.com\/?p=13638"},"modified":"2026-07-27T16:54:16","modified_gmt":"2026-07-27T14:54:16","slug":"trademark-the-general-court-of-the-eu-on-the-invalidity-of-tetra-paks-3d-trademark","status":"publish","type":"post","link":"https:\/\/orsingher.com\/it\/trademark-the-general-court-of-the-eu-on-the-invalidity-of-tetra-paks-3d-trademark\/","title":{"rendered":"TRADEMARK | The General Court of the EU on the invalidity of Tetra Pak\u2019s 3D trademark"},"content":{"rendered":"<p>On\u00a03\u00a0June 2026, the General Court (<em>GC<\/em>) of the EU issued its judgment in <a href=\"https:\/\/infocuria.curia.europa.eu\/tabs\/affair?sort=AFF_NUM-DESC&amp;searchTerm=T%252D104%252F25%25C2%25A0Lami%2520Packaging%2520%28Kunshan%29%2520v%2520EUIPO%25C2%25A0%252D%25C2%25A0Tetra%2520Laval%2520Holdings%2520%2526%2520Finance&amp;lang=EN\" target=\"_blank\" rel=\"noopener\">Case T-104\/25<\/a> (<em>Lami Packaging (Kunshan) v EUIPO\u00a0&#8211;\u00a0Tetra Laval Holdings &amp; Finance<\/em>), annulling the decision of the Board of Appeal (<em>BoA<\/em>) of the European Union Intellectual Property Office (<em>EUIPO<\/em>) and declaring invalid a 3D EU trademark depicting Tetra Pak\u2019s iconic octagonal packaging carton, registered in 2000 for packaging containers and packaging material. The invalidity application\u00a0was based on Article 7(1)(e)(ii) of\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2017\/1001\/oj\/eng\" target=\"_blank\" rel=\"noopener\">Regulation (EU) 2017\/1001 of 14 June 2017 on the European Union trademark<\/a>\u00a0(<em>EUTMR<\/em>), which excludes from registration signs consisting exclusively of a shape necessary to obtain a technical result. The GC disagreed with the\u00a0BoA\u2019s\u00a0finding that the technical functions of the essential characteristics of the shape related only to the manufacturing process and had no bearing on the function of the product. According to the GC, optimising the container\u2019s capacity and reducing its weight\u00a0constitute\u00a0technical results relevant to the targeted public and downstream end-users.
