The issue\u00a0had\u00a0arose during an appeal proceeding against a judgment on a decision of the Italian Competition Authority (<em>ICA<\/em>). In\u00a0the\u00a0said judgment the Italian Administrative Court of\u00a0First\u00a0Instance held that Article 14 of Law No. 689\/1981 \u2013 providing\u00a0that\u00a0the preliminary investigation phase\u00a0should be started\u00a0within 90 days of having the essential elements of the alleged infringement at its disposal \u2013 did not apply to ICA\u2019s proceedings.
