{"id":13579,"date":"2026-07-27T15:18:25","date_gmt":"2026-07-27T13:18:25","guid":{"rendered":"https:\/\/orsingher.com\/?p=13579"},"modified":"2026-07-27T16:19:58","modified_gmt":"2026-07-27T14:19:58","slug":"ai-italy-approves-implementing-measures-for-the-ai-act-strengthening-the-role-of-data-protection-authority","status":"publish","type":"post","link":"https:\/\/orsingher.com\/it\/ai-italy-approves-implementing-measures-for-the-ai-act-strengthening-the-role-of-data-protection-authority\/","title":{"rendered":"AI | Italy approves implementing measures for the AI Act, strengthening the role of Data Protection Authority"},"content":{"rendered":"<p>On 10 June 2026, the Italian Council of Ministers approved, on a preliminary basis,\u00a0<a href=\"https:\/\/www.governo.it\/it\/articolo\/comunicato-stampa-del-consiglio-dei-ministri-n-177\/32050\" target=\"_blank\" rel=\"noopener\">two legislative decrees<\/a>\u00a0(together, the\u00a0<em>Decrees<\/em>), implementing\u00a0<a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:legge:2025-09-23;132\" target=\"_blank\" rel=\"noopener\">Law No. 132 of 2025<\/a>\u00a0(the\u00a0<em>Italian AI Law<\/em>) and complementing Italy\u2019s institutional framework for the application of\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/eli\/reg\/2024\/1689\/oj\/eng\" target=\"_blank\" rel=\"noopener\">Regulation (EU) 2024\/1689<\/a>\u00a0(the\u00a0<em>AI Act<\/em>). The measures\u00a0remain\u00a0subject to the opinions of the competent parliamentary committees and other institutional bodies before their final adoption.<\/p>\n<p>The\u00a0first Decree\u00a0establishes\u00a0Italy&#8217;s governance framework for the implementation of the AI Act. It\u00a0designates\u00a0the competent national authorities, regulates AI literacy and training\u00a0across both the public and private sectors, and lays down sector-specific measures for the deployment of AI in areas such as employment, healthcare,\u00a0education\u00a0and public administration. The\u00a0second Decree\u00a0complements the AI Act by introducing national rules governing the use of AI by law enforcement authorities, as well as provisions on civil liability and criminal offences relating to AI systems. Together, the Decrees do not create a parallel regulatory regime but implement those aspects of the AI Act that require domestic legislation, while reaffirming the principle that AI should support, rather than replace, human decision-making and responsibility.<\/p>\n<p>From a data protection perspective, the most significant development concerns the allocation of supervisory responsibilities. While the Italian Agency for Digital Italy (AgID) is designated as the primary authority for the implementation of the AI Act, the Italian Data Protection Authority (Garante\u00a0per la\u00a0protezione\u00a0dei\u00a0dati\u00a0personali\u00a0\u2013 the\u00a0<em>Italian DPA<\/em>) is expressly entrusted with overseeing all matters involving the processing of personal data. The decrees also\u00a0establish\u00a0coordination mechanisms among the competent national authorities, reflecting the AI Act&#8217;s multi-authority governance model.<\/p>\n<p>The Decrees further reinforce existing safeguards where AI is used in contexts affecting fundamental rights. In employment, decisions producing legal or similarly significant effects cannot be based solely on automated processing and must remain subject to meaningful human intervention.
