{"id":13562,"date":"2026-07-27T14:54:53","date_gmt":"2026-07-27T12:54:53","guid":{"rendered":"https:\/\/orsingher.com\/?p=13562"},"modified":"2026-07-27T15:04:08","modified_gmt":"2026-07-27T13:04:08","slug":"legal-news-in-the-spotlight-the-cjeu-on-the-right-of-withdrawal-for-streaming-subscription-services","status":"publish","type":"post","link":"https:\/\/orsingher.com\/it\/legal-news-in-the-spotlight-the-cjeu-on-the-right-of-withdrawal-for-streaming-subscription-services\/","title":{"rendered":"LEGAL NEWS IN THE SPOTLIGHT | The CJEU on the right of withdrawal for streaming subscription services"},"content":{"rendered":"<p>On 9 July 2026, the Court of Justice of the European Union (<em>CJEU<\/em>)\u00a0delivered its judgment in\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:62025CJ0234\" target=\"_blank\" rel=\"noopener\">Case C-234\/25<\/a>\u00a0(<em>Sky \u00d6sterreich\u00a0Fernsehen\u00a0GmbH v Verein f\u00fcr\u00a0Konsumenteninformation<\/em>), clarifying the definition of \u201cstreaming services\u201d under\u00a0<a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/HTML\/?uri=CELEX:32011L0083\" target=\"_blank\" rel=\"noopener\">Directive (EU) No. 83 of 25 October 2011<\/a> on consumer rights, and its implications for consumers\u2019 right of withdrawal.\u00a0The case concerned Sky \u00d6sterreich\u2019s \u201cSport &amp; Live TV\u201d and \u201cFiction &amp; Live TV\u201d streaming subscriptions, whose terms required consumers to agree that performance would begin before the expiry of the 14-day withdrawal period, resulting in the loss of that right.\u00a0The CJEU was asked whether such subscriptions\u00a0constitute\u00a0the supply of digital content or a digital service, since the applicable withdrawal regime differs significantly. The\u00a0CJUE\u00a0held that the technical means of delivery, including streaming, and the continuous supply of\u00a0content\u00a0are not decisive. Rather, the distinction depends on the nature of the trader&#8217;s offering and, in particular, on\u00a0the degree of the trader&#8217;s involvement in supplying the digital data. A service qualifies as a digital service where the trader provides a dynamic offering that goes beyond the mere provision of specific content, for example by continuously updating the service or adapting it to users\u2019\u00a0behaviour\u00a0through\u00a0personalised\u00a0recommendations, playlists,\u00a0favourites\u00a0or similar features. In the present case, and subject to verification by the Austrian Supreme Court, the CJEU considered that Sky \u00d6sterreich\u2019s streaming service must be classified as a digital service, given the dynamic nature of the offering. Consequently, consumers cannot lose their 14-day right of withdrawal merely because they have started using the service.
