Ristorazione ruling"},"content":{"rendered":"<p>On 12 June 2026,\u00a0<a href=\"https:\/\/www.normattiva.it\/uri-res\/N2Ls?urn:nir:stato:decreto.legge:2026;100\" target=\"_blank\" rel=\"noopener\">Law\u00a0Decree\u00a0No. 100 of 12 June 2026<\/a>\u00a0(the\u00a0<strong><em>Law\u00a0Decree<\/em><\/strong>)\u00a0entered into force,\u00a0amending\u00a0the regime governing interim\u00a0injunctions capable of\u00a0anticipating\u00a0the effects of\u00a0a\u00a0judgment on the merits under the Italian Industrial Property Code and the\u00a0Italian\u00a0Copyright\u00a0Law. The reform follows the CJEU&#8217;s\u00a0judgment of 23 April 2026 in <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A62025CJ0132\" target=\"_blank\" rel=\"noopener\">Case C-132\/25<\/a> (<em>M.M.\u00a0Ristorazione\u00a0Srl v Villa\u00a0Ramazzini\u00a0Srl<\/em>), which held that Directive 2004\/48\/EC on the enforcement of\u00a0IP\u00a0rights (the\u00a0<strong><em>Enforcement Directive<\/em><\/strong>) precludes national rules allowing\u00a0such\u00a0anticipatory\u00a0injunctions\u00a0to remain permanently effective where the claimant does not\u00a0commence\u00a0proceedings on the merits.\u00a0Under the new regime\u00a0introduced by the Law Decree, an anticipatory interim\u00a0injunction\u00a0must be declared ineffective where (a)\u00a0the party who obtained it fails to commence proceedings on the merits within 31 calendar days of the\u00a0injunction\u00a0being granted; and\u00a0(b)\u00a0the\u00a0addressee of the injunction\u00a0files an application for a declaration of ineffectiveness within a further 30-days\u00a0term.\u00a0As\u00a0regards\u00a0injunctions\u00a0granted before\u00a0the entry into force\u00a0of the Law\u00a0Decree,\u00a0their addressees may apply for\u00a0their\u00a0revocation within\u00a060\u00a0days from 12 June 2026.\u00a0The\u00a0Law\u00a0Decree\u00a0is currently before Parliament for conversion into law.
