REAL ESTATE | The Municipal Council of Milano on the Urban Planning Proceedings in Milan: New Guidelines on Substitute Administrative Agreements

On 23 December 2025, the Municipal Council of Milan approved Resolution No. 1634, which set out guidelines aimed at the conclusion of building and planning procedures through the execution of substitute or supplementary agreements between the municipal administration and private parties concerned, pursuant to Article 11 of Law No. 241/1990.

The Council expressly acknowledges that such agreements constitute the appropriate legal instrument through which the administration and the private parties may jointly regulate the continuation and outcome of the pending proceedings, recognizing a significant public interest in continuing proceedings that are already at an advanced stage of investigation, in accordance with the principles of preservation of documents and non-aggravation of administrative proceedings.

Under such agreements, applicants are required to submit a new application in accordance with the current guidelines and to waive any pending or future litigation.

The measure is declared immediately enforceable.
