REAL ESTATE | Extension of the Validity Period of Building Permits and Urban Planning Agreements

Law No. 26 of 27 February 2026, which came into force on 1 March 2026, converted, with amendments, Decree-Law No. 200 of 31 December 2025 (the so-called Milleproroghe Decree 2026).

Among the main changes, the conversion law amends Article 10-septies of Decree-Law No. 21 of 21 March 2022 (the so-called Ukraine Decree), extending the deadline for building permits from 36 to 48 months. The extension concerns the deadlines for the start and completion of works provided for in Article 15 of Presidential Decree No. 380/2001, with reference to building permits issued or formed up to 31 December 2024, provided that the deadlines have not already expired on the date of notification by the interested party.

The regulation also applies to SCIA (certified notification of commencement of works), landscape authorizations and environmental declarations and authorizations. The same extension to 48 months also applies to the validity period and the start and end dates of works under land subdivision agreements (convenzioni di lottizzazione) and equivalent urban planning agreements provided for by regional legislation formed until 31 December 2024.
