PATENT | WIPO’s new Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge adopted

On 24 May 2024, the member States of the WIPO adopted the WIPO Treaty on Intellectual Property, Genetic Resources and Traditional Knowledge Associated with Genetic Resources (the “Treaty”). The objective of the Treaty is to improve the effectiveness of the patent system in relation to (non-human) genetic resources and traditional knowledge associated with generic resources, and to prevent patents from being granted erroneously for inventions that are not novel or inventive. The Treaty sets forth some disclosure requirements for patent applicants, such as the disclosure of the country of origin of the genetic resources, the Indigenous Peoples or local community who provided the traditional knowledge associated with the generic resources. The Treaty will enter into force three months after at least 15 contracting parties have deposited their instruments of ratification or accession.
