PATENT | UPC Local Division of Milan on service of interim seizure orders

On 14 July 2025, the UPC Local Division of Milan issued its decision on case no. 770/2024, shedding some light on the effect of refusal of receiving a service through alternative methods in the context of provisional measures enforced in Italy. Specifically, the Local Division had granted an ex-parte seizure during a trade fair in Milan, allowing service through alternative methods during the enforcement of the measure at the fair. However, the service was not accepted by the defendants’ representative at the fair. In the subsequent proceedings on the merits, the defendant challenged the alleged lack of proper service. The Local Division rejected the defendant’s claim holding that, based on applicable national procedural law, the refusal to accept the service at the stand entails the positive completion of the service. The decision of the UPC is not appealable and therefore, it is final.
