INDUSTRIES, LIFE SCIENCES | Central Division of the UPC on patentability of a therapeutic antibody invention

On 16 July 2024, the Munich Central Division of the UPC issued a decision on case ACT_459505/2023, revoking a patent claiming the use of an antibody for treatment/prevention of hypercholesterolemia or atherosclerotic diseases by means of the antibody’s ability to bind to the catalytic domain of a specific protein. The Central Division considered that the patent at issue lacked an inventive step in that – based on the prior art – a skilled person would have been able to develop therapeutic antibodies for the interested protein target and would have done so with a reasonable expectation of success without undue burden.
