LEGAL NEWS IN THE SPOTLIGHT | The EU Code of Practice and Guidelines on AI regulation and GPAI models released

On 2 August 2025 the provisions of Regulation (EU) 2024/1689 (AI Act) relating to general purpose artificial intelligence (GPAI) models have entered into force. Several important developments concerning GPAI models have also taken place at a European level in parallel. On 10 July 2025, with a press release, the Commission declared that it had received the final version of the GPAI Code of Practice (Code of Practice) a voluntary framework prepared by independent experts to help companies align with the obligations set out in the AI Act. On 18 July 2025, the Commission released the “Guidelines on the scope of obligations for providers of general-purpose AI models under the AI Act” (Guidelines). Although not legally binding, the Guidelines outline the Commission’s interpretation of the AI Act and aim to provide legal certainty to stakeholders by clarifying when and how obligations related to GPAI models apply. On 1 August 2025, through Opinion C (2025) 5361 (Opinion), the Commission confirmed the adequacy of the Code of Practice as a voluntary tool to demonstrate compliance with AI Act. Adhering to the Code of Practice offers providers a clear and practical route to compliance, while reducing administrative burdens and increasing legal certainty.
