LEGAL NEWS IN THE SPOTLIGHT | AGCOM fines Cloudflare over EUR 14 million for failure to block infringing websites

On 8 January 2026, AGCOM issued Resolution No. 333/25/Cons (the Cloudflare Resolution), imposing an administrative fine of over EUR 14 million on Cloudflare for failing to block infringing websites reported through Piracy Shield. The Resolution states that (a) with Resolution No. 401/24/Cons AGCOM called upon all relevant ISPs to subscribe to Piracy Shield; (b) such Resolution was formally served on Cloudflare by international registered mail, however Cloudflare neither responded nor subscribed to Piracy Shield; (c) therefore, with Resolution No. 49/25/Cons (the Order) AGCOM ordered Cloudflare to block all domain names and IP addresses reported via Piracy Shield over the previous six months, as listed in Annex A to the Order, and to inform AGCOM of the measures adopted to comply with the Order; (d) Cloudflare never responded to the Order nor implemented the required blocking measures; (e) in light of Cloudflare’s violation of the Order, AGCOM imposed an administrative sanction amounting to EUR 14,247,698.56, taking into account all relevant circumstances, including the severity of the violation and Cloudflare’s lack of cooperation, as well as its technical expertise and financial standing.
