LABOUR | Italian DPA approves new Code of Conduct for Employment Agencies

On 11 January 2024, the Italian Data Protection Authority (Italian DPA) approved the first Code of Conduct for Employment Agencies (the “Code”). Proposed by the Italian national association of employment agencies, “Assolavoro”, the aim of the Code is to regulate the processing of personal data concerning job candidates and employees throughout the screening, recruitment and selection processes. Agencies are now free to adhere to the Code, with oversight of compliance provided by a newly established supervisory body. Among its core objectives, the Code prioritises the fair and transparent collection and processing of data, emphasising the prevention of discriminatory practices. The Code also addresses contemporary market dynamics, acknowledging the growing influence of social networks in candidate sourcing and selection.
