INDUSTRY, E-COMMERCE | Introduction of a renewal reminder obligation in the Italian Consumer Protection Code

Law No. 214 of 30 December 2023 (Italian Annual Market and Competition Law) introduced a new provision, Article 65-bis, to the Italian Consumer Protection Code, setting the obligation for traders to send a notice to customers 30 days before the upcoming expiration date of fixed term contracts with a tacit renewal clause.  Article 65-bis also provides that in case of non-compliance, the consumer may withdraw at any time without charge until the next contract expiration date.
