INDUSTRIES, PUBLIC TENDER | Certifications issuance of work carried out in fulfilment of contracts implementing framework agreements: ANAC press release

On 19 March 2025, the Italian Anti-Corruption Authority (ANAC) ruled on an exception to the principle by which each individual contract implementing Framework Agreements must give rise to the issue of a certificate of work procedure (“CEL”), according to Article 59 of the Public Contracts Code.

According to ANAC, a different solution may be accepted when a tendering authority signs several implementation contracts under a single Framework Agreement with a single economic operator, if the implementation contracts relate to the same site and are carried out in spatial and temporal continuity. In these contexts, the sole procedure manager (“RUP”), in addition to issuing a CEL for each implementation contract, will subsequently issue cumulative CELs, adding up the work already certified with the individual CELs previously issued, which will be cancelled and replaced by the latter CEL.

This solution seems to be suitable not to frustrate the expectations of economic operators, who will be able to obtain recognition of the overall values of the processes entrusted individually. This method of issuance will be allowed from 1 July 2025, given the need to update the application services in use.
