AGCOM issues prominence Regulation for Services of General Interest (SGI)

On 15 October, the Italian media regulator AGCOM published Annex A to Regulation 390/24/CONS setting forth the rules on prominence for services ‘of general interest’ (‘SGI’) (the ‘Prominence Regulation’). In summary, the Prominence Regulation: (a) sets the rules to identify the SGI (including the request that SGI providers apply to be recognised as such by the regulator). AGCOM will publish the list of SGI within 120 days from the publication of the Prominence Regulation; (b) applies to manufacturers of devices and user interfaces installed on television sets or similar devices, while AVMS and app stores are expressly excluded from the scope of the Prominence Regulation. AGCOM will publish the list of producers of devices and interfaces subject to the provisions of the Prominence Regulation within 120 days from the publication of the Prominence Regulation; (c) provides for the introduction of four icons in a rail on the home page of relevant devices/interfaces; (d) provides that the position of the icons can be changed by the user in accordance with their preferences through autonomous intervention (but their position cannot be changed by algorithmic or automatic logic); (e) provides that the measures set forth in the Prominence Regulation will enter into force 12 months after the publication of the list of SGI (therefore within 18 months from publication of the Prominence Regulation) and apply to all devices/interface produced by suppliers identified by AGCOM (even those already marketed at the date of publication of the Prominence Regulation).
