INDUSTRIES, MEDIA | New rules on definition of “theatrical work” released

The Ministry of Culture (Mic) has published the Decree 22 January 2025 setting among other things, the new ‘theatrical window’ for films that benefit from state funding (tax credits and other incentives) as ‘theatrical works’. The main provision of the decree are that (a) the 105-day window from the first screening (during which the film cannot be broadcast by audiovisual media services in Italy) has been maintained; (b) the shortened 60-day window (for minor films) has been eliminated; and (c) the theatrical distribution requirements have been increased.  The new rules apply to films for which no application for Italian nationality has been submitted as of the date of publication of the Decree.
