INDUSTRIES, ENERGY | Lombardy Implements Legislative Decree No. 190/2024 on Suitable Areas for Renewable Energy Installations

By Regional Law No. 10 of 21 May 2026, the Lombardy Region implemented Legislative Decree  No. 190 of 25 November 2024 by regulating the identification of areas suitable for renewable energy plants and introducing significant restrictions on their development within agricultural land.

Article 1 requires the Regional Executive (Giunta regionale) to map the areas deemed suitable under Article 11-bis of Legislative Decree No. 190/2024, as well as agricultural land already occupied by renewable energy installations.

Article 2 provides that land used for renewable energy plants and battery energy storage systems may not exceed 0.8% of the Region’s total agricultural land in use, while also introducing municipal thresholds of 3%, which may be increased to 5% or 10% in specific cases. Once these limits are reached, new applications for ground-mounted photovoltaic and agrivoltaic plants become inadmissible.

Article 5 requires agrivoltaic plants to preserve at least 80% of gross agricultural output and to implement monitoring systems assessing their impact on agricultural productivity, water use, soil conditions and the continuity of farming activities.
