INDUSTRIES, ENERGY | Consolidated Renewables Act: amending corrective decree approved

Legislative Decree No. 178/2025, approved by the Council of Ministers, was published in the Official Gazette on 26 November 2025, supplementing and partially amending the Consolidated Law on Renewable Energy Sources (Legislative Decree No. 190 of 25 November 2024). The new provisions entered into force on 11 December 2025. The decree refines the permitting framework for renewable energy projects, with the dual objective of simplification and progressive digitalisation.

It extends the notion of “hybrid plant” to include systems combining several renewable sources or integrating storage facilities or electrolysers. For interventions under the free-activity regime, it explicitly admits certain floating photovoltaic plants below 10 MW and the revamping of existing PV plants, provided there is no increase in volume or occupied surface.

The decree also clarifies that, for Simplified Enabling Procedure (PAS), the competent authority is the municipality in whose territory the prevailing portion of the plant is located.

With regard to projects requiring Single Authorization (AU), the Region delegated body or the Ministry of the Environment and Energy Security is designated as the single contact point.

A key innovation is the comprehensive reform of the SUER digital platform, which becomes the central electronic channel for guidance and interaction with the administrations involved.

Finally, a new Article 12-ter empowers ARERA, supported by Acquirente Unico S.p.A., to establish decision-making alternative dispute-resolution mechanisms for disputes on electronic submissions, simplified procedures and the identification of the applicable administrative regime.
