GEOGRAPHICAL INDICATIONS | The Italian Supreme Court on the use of “Aceto” and “Balsamico” and infringement of “Aceto Balsamico di Modena” PGI

On 17 April 2024, the Italian Supreme Court issued its order No. 10352/2024, on whether the use of the words “Aceto” and “Balsamico” constitutes an infringement by evocation of the Protected Geographical Indication (PGI) “Aceto Balsamico di Modena“. In accordance with the relevant European case law, the Supreme Court ruled that “Aceto” and “Balsamico” are generic terms that describe a product and its qualities. As they do not indicate the origin of the product, they cannot be appropriated and their use should remain available to all traders.
