COPYRIGHT | The Court of Naples on copyright protection for designs with a predominantly functional character

On 28 May 2024, the Court of Naples handed down its Judgment No. 5551/2024 in a case concerning the alleged infringement, inter alia, of copyright for certain home furnishings. The Court held that there was no predominance of the artistic value over the practical utility of the design allegedly infringed by the defendants and that, therefore, the design could not be protected by copyright under Article 2(1)(10) of the Italian Copyright Law.
