CONSUMER LAW | Law Implementing Directive (EU) 2023/2673 enacted

On 2 October 2025, acting under the delegation granted by the Italian Parliament through the 2024 European Delegation Law, and upon the proposal of the Minister for European Affairs and other competent Ministers, the Italian Council of Ministers (the Council) approved in preliminary examination the draft Legislative Decree implementing the Directive (EU) No. 2673 of 22 November 2023 on financial services contracts concluded at a distance (the Directive). The draft Legislative Decree has not yet been published, but according to the official statement of the Council, the decree aims at strengthening consumer protection by updating the Italian Consumer Code (ICC). In line with the Directive, the main changes to the ICC will include (a) enhanced rules on the communication of pre-contractual information to consumers; (bii) the introduction of an easily accessible “withdrawal function” for online contracts; (c) additional safeguards against the dark pattern consisting of misleading user interfaces, the so-called “dark pattern”. The overarching goal is to ensure greater transparency and clarity in distance and online financial contracts, enabling consumers to make informed decisions and to easily exercise their right of withdrawal.
