CONSUMER LAW | AGCM fines Poltronesofà for misleading advertising

On 16 December 2025, the Italian Competition Authority (AGCM) concluded proceedings PS12919 by imposing a euro 1 million fine on Poltronesofà S.p.A. (the Company) engaging in unfair commercial practices in violation of the Italian Consumer Code. According to the AGCM, the Company failed to correctly indicate prices and discounts during its promotional campaigns. In particular, it systematically highlighted the existence and appeal of reduced prices and time-limited discounts calculated against significantly higher full prices which were rarely, if ever, actually applied. The AGCM found that this marketing strategy misled consumers by falsely portraying ordinary prices as temporary and heavily discounted. This decision reaffirms the Authority’s strict stance against promotional tactics that distort consumers’ perception of value and urgency.
