ANTITRUST | The Italian Administrative Court of First Instance reduced Amazon logistics fine

On 2 September 2025, the Italian Administrative Court of First Instance of Lazio (TAR Lazio) partially upheld the action for annulment brought by certain Amazon Group entities Appellants) against the Italian Competition Authority (ICA)’s decision that had sanctioned them for allegedly abusing their dominant position in the markets for e-commerce logistics services and marketplace intermediation. The TAR Lazio considered well-founded the Appellants’ complaint regarding the lack of reasoning behind the additional 50% increase imposed by the ICA on the base amount of the fine, and therefore has disposed of the reduction of the original fine imposed by the ICA. In this regard, TAR Lazio deemed the ICA’s grounds to be insufficient and inadequate, as they were based solely on the Appellants’ global turnover, which constituted the prerequisite for the application of the increase. Furthermore, the ICA failed to specify the reasons behind the 50% uplift or explain why it was proportionate to the circumstances of the case.
