AI | European Commission updates draft of Code of Practice on AI-generated content

On 3 March 2026, the European Commission published the second, updated draft of the Code of Practice on the marking and labelling of AI-generated content (Draft Code), pursuant to Article 50 of AI Act. The updated draft incorporates feedback received from stakeholders, Member States and Members of the European Parliament.

Compared to the first version, the Draft Code adopts a more practical and flexible approach, with the aim of simplifying compliance and reducing the associated administrative burden for providers and deployers of AI systems.

The Draft Code is open for public consultation until 30 March 2026. According to the Commission’s updated timeline, the final version is expected to be published in early June 2026, ahead of the applicability of the transparency obligations under Article 50 of AI Act on 2 August 2026.
