AI | EU Commission releases first draft of Code of Practice on AI-generated content

On 17 December 2025, the EU Commission published the first draft of the Code of Practice on the marking and labelling of AI-generated content (Draft Code), pursuant to Article 50 of AI Act, following a multi-stakeholder public consultation. The Draft Code aims to support compliance with the AI Act’s transparency obligations by providing guidance on marking and detection of AI-generated or manipulated content, as well as on the labelling of deepfakes, enabling individuals to recognise AI-generated content. The Draft Code is currently structured into two sections: the first is addressed to providers of generative AI systems and sets out requirements on the marking in a machine-readable format of AI-generated or manipulated content; the second is addressed to deployers and focuses on the labelling in a human-readable format of deepfakes and AI-generated or manipulated text. Discussions on the Draft Code are ongoing and further amendments are expected. According to the EU Commission’s timeline, the final version of the Code of Practice is expected to be published between May and June 2026.
