AI | Digital Omnibus AI pushes forward entry into force of AI Act

On 27 July 2026, the Regulation (EU) 2026/1744 (Digital Omnibus AI), which was approved on 8 July 2026 as part of the digital omnibus package entered into force. Digital Omnibus AI mainly introduces targeted amendments to the AI Act aimed at simplifying its implementation and reducing the administrative burden on businesses, while also extending the timeline for the application of certain high-risk AI requirements. In particular, some simplified requirements previously applicable to small and medium enterprises have been extended to small mid-cap companies, while obligations relating to AI literacy and the registration in the EU database of certain AI systems that providers consider not to be high-risk have been simplified. Most relevantly, Digital Omnibus AI postponed the application of the AI Act requirements for high-risk AI systems. After the entry into force of the new legislation, the requirements concerning high-risk AI systems falling within the use cases listed in Annex III will apply from 2 December 2027, while those concerning high-risk AI systems that are safety components of, or themselves constitute, products covered by the EU harmonization legislation listed in Annex I will apply from 2 August 2028.
