ADMINISTRATIVE | Regional Administrative Court of Campania on variants to a public works contract

On 29 August 2024, the Regional Administrative Court of Campania – Naples issued its Judgment in case No. 4745, confirming its previous case, according to which improvements that, without affecting the structure, function and type of the project, contribute making it better corresponding to the needs of the contracting authority, are admissible. Notably, variants consisting of changes to the original project, from a structural and functional standpoint, are admissible only to the extent they meet the minimum requirements laid down in the public tender documents by the contracting authorities.
