ADMINISTRATIVE | New EU Thresholds for Public Procurement and Concessions (2026–2027) enacted

On 22 October 2025, the European Commission adopted three Delegated Regulations – (EU) 2025/2150, (EU) 2025/2151, and (EU) 2025/2152 – amending respectively Directives 2014/25/EU, 2014/23/EU, and 2014/24/EU in order to update the applicable thresholds for public procurement and concession contracts for the 2026–2027 period.

These revisions, entering into force on 1 January 2026, will ensure consistency with international commitments, as well as promoting open competition in public markets.

Under the updated framework, the ordinary sectors will be subject to thresholds of euro 140,000 for public supply and service contracts awarded by central government authorities, and euro 216,000 for contracts awarded or organized by sub-central contracting authorities.

The threshold for concession contracts has been harmonised at euro  5,404,000 across all sectors.

Finally, in the special sectors – covering water, energy, transport, and postal services – the thresholds are set at euro 432,000 for supply and service contracts, and euro 5,404,000 for public works contracts.
