ADMINISTRATIVE | Italian Government approves draft of Corrective Decree to the Code of Public Contracts

On 21 October 2024, the Council of Ministers approved a preliminary draft legislative decree (the “Corrective Decree”) introducing additional and corrective provisions to Legislative Decree No. 36 of 31 March 2023 (the “Public Contracts Code”).  The Corrective Decree is intended to simplify the existing public procurement legislation by resolving some critical issues that arose during the application of the Public Contracts Code and also considering the needs represented by sector stakeholders and requests for amendments by the European Union. The Corrective Decree amends 78 articles, adds 3 articles and provides for 3 new annexes (regarding the following areas: fair payments, labour protection, digitalisation of public contracts, price revision, qualification of contracting authorities, consortia, protection of micro, small and medium-sized enterprises, the contract execution phase and public-private partnerships). Following the preliminary approval of the Council of Ministers, the draft legislative decree will be examined by the State-Regions Conference, the Council of State and finally by the Parliamentary Committees. The Government aims to conclude the process by 31 December 2024.
