The Court stated that, when an illegal construction is carried out on a property, the recipients of the demolition order provided in <a href=\"https:\/\/www.gazzettaufficiale.it\/eli\/id\/2001\/11\/15\/01A12340\/sg\" target=\"_blank\" rel=\"noopener\">Article 31 of Presidential Decree No. 380 of 6 June 2011<\/a> (Italian Consolidated Law on Building Construction) are the owner of the real estate property and the third party who committed the abuse.\u00a0Hence, the owner of the property can be notified of the demolition order even if they are not liable for carrying out the illegal work.\u00a0\u00a0However, the Court stated that, if the construction abuse was not committed by the owner, they can avoid incurring the abovementioned penalty if they can prove they are not guilty.\u00a0To do so, they must prove that they had undertaken activities showing they are not involved in the abuse and that force the person responsible for the unlawful action to restore the site\u2019s original conditions.\u00a0To conclude, the Court emphasised that a mere formal notice is not sufficient to compel the liable person to restore the state of the place.<\/p>\n<p>Newsletter n. 97 &#8211; June 2024<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 19 April 2024, the Italian Council of State issued its judgment in case No. 3574.
