When the tender documentation provides that experience-based requirements must be fulfilled by the association as a whole, a temporary association of companies cannot be excluded solely due to a lack of correspondence between the qualification shares and the execution shares.<\/p>\n<p>The obligation to align qualifications with performance applies only to public works contracts, pursuant to Article 68 and Article 100, but not in service contracts, where the rules set out in the tender documents prevail.<\/p>\n<p>Automatic exclusion is not permitted, especially in light of the Council of State\u2019s Plenary Assembly Judgment No. 27\/2014, which affirmed the legitimacy of aggregating requirements among associated companies.<\/p>\n<p>Newsletter n. 112 \u2013 November 2025<\/p>\n","protected":false},"excerpt":{"rendered":"<p>On 15 September 2025, the Regional Administrative Court of Salerno reaffirmed a well-established principle concerning technical and professional requirements in service and supply contracts, with reference to Articles 68 and 100 of Legislative Decree No. 36\/2023.
