Local television: OOAA with the A.L.P.I. RADIO TV Association
The Constitutional Court declares that the “preferential step” mechanism is fully compatible with the principles of pluralism of information and competition.
In its decision no. 44 of 15 April 2025, the Constitutional Court settled a long-standing issue concerning public subsidies to local television broadcasters. In particular, the Constitutional Court declared unfounded the question of the constitutionality of article 4-bis of Decree-Law no. 91 of 25 July 2018 (extension of the periods provided for by legislative provisions), converted with amendments into Law no. 108 of 21 September 2018, and of art. 13, paragraph 1-bis, of Decree-Law No. 145 of 18 October 2023 (Urgent measures on economic and fiscal matters, in favour of territorial entities, to protect employment and for unavoidable needs), converted, with amendments, into Law No. 191 of 15 December 2023.
